localmoney.org is operated by BMC SAASY TECH LTD, a company registered in England & Wales (company number 12454158), registered office Flat 338, 372 Old Street, London, EC1V 9LT (“we”, “us”). This policy applies to Earn Spot subscriptions and forms part of our Terms of Use.
If you are a resident unlocking earning hours at a local business, you pay us nothing. Nothing in this policy applies to you: unlocking is free.
All prices shown at checkout are the total you pay and include UK VAT where applicable. Earn Spots are billed monthly in advance through Stripe, our payment processor. We never see your card details.
An Earn Spot is a digital service. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you would ordinarily have 14 days to cancel a distance purchase. However, your subscription gives you immediate access — your spot goes live and can be unlocked as soon as payment completes. At checkout you expressly consent to us supplying the service immediately, and you acknowledge that once supply has begun you lose your 14-day right to cancel. We confirm this consent in your purchase receipt. This means that once your spot is live, payments are non-refundable except as set out below or where the law requires.
You can cancel your Earn Spot at any time. Your spot then stays live to the end of the period you have already paid for, no further payments are taken, and nothing is cut off early. Cancelling does not refund the current period.
Cancel yourself, whenever you like, from the manage link you were given when you claimed your spot — no need to ask us and no waiting. It tells you the exact date your spot ends before you confirm, and you can change your mind any time before that date. If you have lost the link, email us from the address you paid with and we will cancel it for you.
After that date your spot comes off the map, customers can no longer unlock earning hours with you, and the footfall and dwell information you have been receiving stops.
Because a spot goes live immediately and is billed month by month, and to the extent permitted by law, we do not offer refunds or credits for:
— change of mind after your spot has gone live;
— partly used billing periods or unused time;
— how many people do or do not visit, or how many unlocks your spot generates;
— downtime, interruptions or defects in third-party services we do not control, including mapping providers, payment providers and the location services on visitors’ own devices;
— suspension or termination of your spot for breach of our Terms of Use.
We will, however, put right anything that is our error — a duplicate charge, a charge after you cancelled, or a spot that never went live. Email us and tell us what happened.
Nothing in this policy affects your statutory rights under the Consumer Rights Act 2015 where they apply to you. If the service itself is faulty — not merely quieter than you hoped — you are entitled to have it repaired or replaced, and where that is not possible, to an appropriate price reduction. Contact us and we will put it right.
Where an Earn Spot is bought by a business for the purposes of that business, consumer cancellation rights do not apply. Multi-site or bespoke arrangements are sold strictly business-to-business, are non-refundable once the term begins except as expressly agreed in a signed order form, and run for their full term.
We may suspend or end a spot immediately and without refund where we reasonably believe our Terms of Use have been breached, where use presents a security, legal or fraud risk, or where we are required to act by law or a regulator. For Earn Spots that specifically includes placing a geofence over premises you do not operate or over a deliberately wider area, and using unlocks to manufacture visits that did not genuinely happen.
We may also modify, restrict or discontinue any feature, or withdraw the service in whole or in part, at any time. If we permanently withdraw the service, or end your spot for reasons other than those above, your sole remedy is a pro-rata refund of the unused portion of the period you have already paid for — nothing more. We are not liable for any other loss arising from suspension, modification or withdrawal.
If you dispute a payment with your card issuer while your spot remains live, we may suspend it while the dispute is resolved. Where a chargeback is upheld against a payment for a period in which your spot was live, we may recover the value of that use.
This policy is governed by the laws of England & Wales, and the courts of England & Wales have jurisdiction. If any part of it is found unenforceable, the rest remains in force.
